SAY GOOD-BYE TO IN-PERSON SEVILLA BOARD MEETINGS

Are in-person board meetings gone for the immediate future?  Do homeowners know that board meetings are now virtual through ZOOM? How did the board of directors communicate this to homeowners? Has the board of directors in conjunction with Diversified coordinated this action properly?

Apparently the Sevilla Board of Directors decided to begin virtual ZOOM monthly board meetings beginning June 18, 2024. It is unclear when they made that decision since it was never agendized or discussed in recent board meetings. It is unclear if this action is short-term or will continue on as the board meeting preference.

Effective January 1, 2024, California Civil Code 4926 permits an HOA to hold virtual board meetings without a physical location. The intent was to enhance greater access and participation for homeowners. Board directors can also hold hybrid meetings that are both virtual and in-person.

For the Sevilla HOA, the move toward virtual board meetings may be extremely beneficial for those who can’t attend in-person board meetings. There are many homeowners who are disabled or rent their homes and live elsewhere and cannot participate in board meetings at the community pool or at the management company’s office.

However, the Board of Directors failed to make this transition in the right way by not communicating with all homeowners.

• No advance notice

• No posted agenda at the community pool

• No posted agenda at the community pool at least 4 days before the June 18th board meeting as required by the CC&Rs and the California Civil Code

• No clear instructions for on how to participate by ZOOM

• No telephone number and email address of someone who can provide technical assistance both before and during the board meeting

Why is it so difficult for the Sevilla Board of Directors to be transparent and communicate with all homeowners regarding how and where future board meetings will take place?
