Pesticides and the HOA

Unbeknownst to many Sevilla Homeowners and Residents, the Association posted at the Association Pool a notice from Artistic regarding pesticide treatment from June 19-23 throughout the Sevilla Community in the common areas. This posted Notice failed to provide all details required by California Civil Code 4777.

The pesticides to be spot sprayed throughout the community included Speed Zone EPA Reg. No. 2217-833 or Ranger Pro Herbicide EPA Reg No. 524-517 which were to be used for weeds and broadleaf.

The Association and Artistic decided to postpone the spraying of the pesticide to June 26-30 and then another postponement to July 5-7. Finally, the Association posted the required pesticide details on the pool bulletin board.

It would behoove the Association to better inform its members regarding the use of pesticides within the community and provide safety cautions for those residents who are elderly, have medical issues, children, or pets.

Civil Code §4777  Common Areas. At least 48 hours prior to application of the pesticide to a common area, the association or its authorized agent shall, if practicable, post the written notice described in paragraph (1) in a conspicuous place in or around the common area in which the pesticide is to be applied. Otherwise, if not practicable, the association or its authorized agent shall provide individual notice to the owner and, if applicable, the tenant of the separate interest that is adjacent to the common area.
