Disclosure: Did You Know That the Board of Directors Have Hired Another Law Firm?

Apparently, the Board has hired its 4th law firm since April 2022. First Whitney Petchul was fired in April 2022 by 4 members of the Board approximately one week before the Annual Meeting and Election. Tinnelly Law Group was then hired to dismiss the 1st Recall Petition. In November 2022, unknown to most Sevilla homeowners, Tinnelly Law Group was no longer legal counsel for the Association. Along comes Attorney David Cane to Kimberly Clark’s Recall Election on November 29, 2022, and actively participates in the proceedings. When asked that evening, no board directors would confirm when he was hired to be counsel for the Association. Weeks later there were comments made by the property manager that he was an observer at the Recall Election Meeting. A signed contract dated January 17, 2023, was produced almost 2 months after his participation in the Recall Election. And now the Association has contracted with the law firm Iger, Wankel, and Bonkowski according to Attorney Christopher Bonkowski, but not confirmed by the Association.

The Sevilla HOA Board never indicated to the members of the Association that Attorney David Cane and his law firm was hired as legal counsel for the Association. The Sevilla HOA Board never indicated to the members of the Association that Attorney Chris Bonkowki and his firm was hired as legal counsel for the Association. There are no Executive or General Session Agendas or Minutes that indicate that the Board was considering changing law firms or the firing/hiring of law firms from January 2023 through today’s date of July 10, 2023.

Where is the transparency?  Why does the Association keep changing Attorneys? Why doesn’t the Board inform the Association Membership of these changes? Does the Board feel that these law firms are providing poor legal advice? Ask questions.
