Annual Disclosures
On November 11, 2024, a packet of disclosures was mailed to each homeowner that was supposed to include the approved 2025 Fiscal Year Operating Budget, Reserve Justifications, Summary of Dispute Resolution Procedures, Insurance Notification, Association Election Procedures, Associations Rules and Regulations, Association Parking Procedures, etc. It is unclear why this packet is so disorganized and missing so much required information.
Disclosure Fallacies
• No Proforma Operating Budget for Fiscal Year 2025 was included in the packet as required by law.
• Missing pages for the Assessment and Reserve Funding Disclosure Summary.
• General Rules – Missing are pages 1, 3, and 5.
• Dispute Resolution Procedures – Missing description of Early Dispute Resolution/Internal Dispute Resolution Procedures. Missing description of how Alternative Dispute Resolution as facilitated in the Sevilla HOA.
• No current Election Procedures included. The election rules and procedures for 2019 were not provided.
• Missing page(s) for Charges for Documents.
• No parking Association Parking Procedures, just a parking application for an outside space. Parking Rules have not been adopted by the board for several years.
