Rats Within the Sevilla HOA

As every homeowner knows, the rat issue in the Sevilla HOA continues to be a major issue. Rats within the Sevilla Community have been an issue of concern for many years. They continue to be a major issue for many homeowners including one family that continues to be burdened with an alarming number of rats on the exterior of their home. The photo below is of a dead rat outside an upstairs bedroom window that the HOA refused to dispose of.

Rat Bait stations containing only poisonous food for rat ingestion have been placed around the community for almost eight years, due to the belief that there is a rat problem in the common area of the Sevilla HOA,  but there seems to be no accountability as to the capture of any dead rats. The Board of Directors have not communicated to the homeowners the impact of the rats within the community.

The HOA is responsible for the common area, but yet has not secured the vents of homes throughout the community with wire mesh to prevent rats from entering homes.

It is the board’s fiduciary duty to maintain the common area and provide safeguards to the community, instead of failing member homeowners by allowing the board to negate their fiduciary duty by not acting in the best interest of the CID in good faith and best practices.

The current board of directors hold a different viewpoint despite the acknowledgement that the HOA “has a general responsibility from a health and safety perspective factoring its fiduciary duty to owners” However, it believes that “these criteria are highly subjective and it is in the board’s sole discretion to decide if any specific pest issue should be attended to by the HOA or not”.

Homeowners within this Association, I would think, don’t believe that the homeowner who had the rat running down its front door would be responsible for that rat entering his/her home or another member’s home given that rats have been a common area problem within this Association for many years.
